Some DOL Activity Could be Suspended as a Result of Shutdown

Like a snow day for students when a test is scheduled, some DOL investigations and actions will be delayed as a result of the government shutdown. Extensions on some DOL litigation have already been filed, and routine functions will be put on hold.

There will be exceptions, however, including cases facing statutes of limitation, criminal investigations before grand juries and some bankruptcy cases. The DOL had sent a letter earlier this month asking for exemptions for 85 field workers and those at the national office.

So for those under DOL investigation, enjoy your “snow day.” But before you get too excited, Brian Graff, CEO and Executive Director of NAPA and ASPPA, addresses the DOL’s fiduciary definition rulemaking effort, warning: “It is true that the shutdown will further delay the definition of fiduciary regulation. However, one way or another the government will at some point return to work, and then the DOL will be back at it again.”
