DOMA's Demise and the Effects on Employee Benefit Plans

Now that the U.S. Supreme Court has overturned Section 3 of the Defense of Marriage Act, same-gender married couples must be recognized by the federal government (at least those that were married in the states that permit such marriages). However, it is not clear which federal rights and responsibilities of marriage will be afforded to same-gender married couples who reside in states that do not permit or recognize same-gender marriages. This potentially disparate treatment of same-gender married couples based on their state of residence will have a direct impact on employee benefit plans sponsored by employers across the country, especially those companies that have employees who reside in different states. 

An ASPPA webcast on the decision's impact on benefit plans has been scheduled for Wednesday, July 17, from 2:00 to 3:40 p.m. ET. The speaker will be Ronald J. Triche, Esq., APM, Assistant General Counsel of ASPPA. Triche will discuss the case, its impact on employee benefits, and the many questions left unanswered by the Court.
